These Terms of Service ("Terms") govern your access to and use of the website, applications, and services (collectively, the "Services") provided by 29AI, LLC ("WellPrompted," "we," "us," or "our") at wellprompted.ai. By creating an account or using the Services, you agree to these Terms.

1. Eligibility

You must be at least 16 years old to use the Services. By agreeing to these Terms, you represent that you are at least 16 years of age and have the legal capacity to enter into a binding agreement.

2. Accounts

  • You are responsible for maintaining the confidentiality of your login credentials.
  • You are responsible for all activity that occurs under your account.
  • You must provide accurate and complete information when creating an account.
  • One account per person. Sharing account credentials is not permitted.
  • Notify us immediately at jack@wellprompted.ai if you suspect unauthorized access to your account.

3. Subscriptions and Payments

  • Some features require a paid subscription or one-time purchase.
  • Payments are processed securely by Stripe. By purchasing, you agree to Stripe's terms of service.
  • Subscription fees are billed in advance on a recurring basis (monthly or annually, as selected).
  • You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period.
  • We reserve the right to change pricing with 30 days' notice. Price changes do not affect active billing periods.

4. Acceptable Use

When using the Services, including the Prompt Playground, you agree not to:

  • Submit prompts containing illegal, harmful, threatening, abusive, harassing, defamatory, or obscene content
  • Attempt to extract, reverse-engineer, or circumvent AI scoring or evaluation systems
  • Use automated scripts, bots, or scrapers to access the Services
  • Share, redistribute, or resell course content, videos, or materials
  • Interfere with or disrupt the Services or servers
  • Impersonate another person or entity
  • Use the Services for any purpose that violates applicable law

We reserve the right to suspend or terminate accounts that violate these rules, with or without notice.

5. Intellectual Property

Our content

All course materials, videos, assessments, scoring rubrics, website design, logos, and text are owned by 29AI, LLC and protected by copyright and intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from our content without written permission.

Your content

You retain ownership of prompts and other content you submit through the Services. By submitting content, you grant us a non-exclusive, worldwide, royalty-free license to use, store, and process that content solely for the purpose of providing and improving the Services (e.g., scoring your Playground submissions).

6. Certificates

Certificates of completion are issued based on course progress and assessment scores. Certificates represent completion of WellPrompted coursework only and do not constitute professional certification, accreditation, or endorsement by any third party.

7. Disclaimer of Warranties

The Services are provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or secure.

AI-generated feedback and scores in the Prompt Playground are provided for educational purposes only and should not be relied upon as professional advice.

8. Limitation of Liability

To the maximum extent permitted by law, 29AI, LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or use, arising out of or related to your use of the Services. Our total aggregate liability shall not exceed the amounts you have paid to us in the twelve (12) months preceding the claim.

9. Indemnification

You agree to indemnify and hold harmless 29AI, LLC and its officers, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising out of your use of the Services or violation of these Terms.

10. Termination

We may suspend or terminate your access to the Services at any time for violation of these Terms or for any other reason at our sole discretion. Upon termination, your right to use the Services ceases immediately. Sections 5, 7, 8, 9, and 11 survive termination.

11. Governing Law and Disputes

These Terms are governed by the laws of the State of Missouri, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved in the state or federal courts located in St. Louis County, Missouri.

12. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Services after changes constitutes acceptance of the updated Terms.
